First Monday In October (October 5, 2026)

. . .

J          “They are back.”

. . .

J          “Trump is cranky because his appointees to the Supreme Court are not obedient.  He really deeply basically fundamentally does not get it.”

. . .

K          “I have arrived at a state of mind where I understand my views with greater certainty and conviction and now find some common ground with each of the nine some of the time, depending on the issue.”

. . .

K          “One case may determine whether the oil industry faces billions of dollars in liability for damages caused by global warming.”

J          “What bothers me is that there is clear evidence that the oil industry determined that there would be devastating impact on the environment.  That may be a factual matter rather than a legal issue.”

. . .

K          “The Court must decide whether a plane worth $95,000 at the time should be forfeited for the illegal transportation of a six-pack of beer in Alaska.”

J          “Seems excessive.  The Bill of Rights protects each citizen’s rights, not society’s interests.”

. . .

K          “What are called ‘assault rifles’ are back on the docket.”

J          “Where is the constitutional line?  What is an ‘arm’ that one may ‘keep and bear’ in contemporary society?”

. . .

J          “Nothing really super sexy, yet the term is young.”

. . .
